BackgroundIn its 2015 decision in Montgomery v. Lanarkshire Health Board, the Supreme Court of the United Kingdom overruled the long-standing, paternalistic prudent doctor standard of care in favour of a new reasonable patient standard which obligates doctors to make their patients aware of all material risks of the recommended treatment and of any reasonable alternative treatment. This landmark judgment has been of interest to the rest of the common law world. A judicial trend of invoking Montgomery to impose more stringent (...) requirements on doctors is discernible in subsequent decisions since then.Main bodyIn this narrative review, without questioning the idea that properly informed patients should play a more active role in procedures affecting their own health in furtherance of their autonomy, safety, and consumer rights, we identify and analyse, with the aid of realistic clinical thought experiments, three practical conundrums that the Montgomery standard may inflict on the daily work of doctors, unfairly exposing them to arbitrary legal risks.ConclusionsThese conundrums pertain to the ascertainment of the risks that must be disclosed to the patient under the test of ‘materiality’; the legal uncertainty as to the scope of the exceptions; and the actual ability of doctors to cope with the pressures of time. These conundrums offer ripe opportunities to rethink the proper role of judicially developed medical law in modern health care practice. (shrink)

This book approaches the topic of intercultural understanding in philosophy from a phenomenological perspective. It provides a bridge between Western and Eastern philosophy through in-depth discussion of concepts and doctrines of phenomenology and ancient and contemporary Chinese philosophy. We defend the many-worlds interpretation of quantum mechanics against the objection that it cannot explain why measurement outcomes are predicted by the Born probability rule. We understand quantum probabilities in terms of an observer's self-location probabilities. We formulate a probability postulate for the MWI: the probability of self-location in a world with a given set of outcomes is the absolute square of that world's amplitude. We provide a proof of this postulate, which assumes the quantum formalism and two principles concerning (...) symmetry and locality. We also show how a structurally similar proof of the Born rule is available for collapse theories. We conclude by comparing our account to the recent account offered by Sebens and Carroll. (shrink)

Thomson, Kelvin You might be surprised to learn that China, home of the much derided one-child policy, has a higher birth rate than Italy, home of the Vatican. This suggests Chinese families are quietly defying their political leaders and Italian families are quietly defying their religious ones. But the overall global picture is one of rapid population growth.

Various tests have been proposed as helps to identify intrinsic properties. This paper compares three prominent tests and shows that they fail to pass adequate verdicts on a set of three properties. The paper examines whether improved versions of the tests can reduce or remove these negative outcomes. We reach the sceptical conclusion that whereas some of the tests must be discarded as inadequate because they don’t yield definite results, the remaining tests depend for their application on the details of (...) fundamental particle physics so much so that they cannot be relied upon. Junior researchers can be abused and bullied by unscrupulous senior collaborators. This article describes the profile of a type of serial abuser, the White Bull, who uses his academic seniority to distort authorship credit and who disguises his parasitism with carefully premeditated deception. Further research into the personality traits of such perpetrators is warranted.

Under what conditions are material objects, such as particles, parts of a whole object? This is the composition question and is a longstanding open question in philosophy. Existing attempts to specify a non-trivial restriction on composition tend to be vague and face serious counterexamples. Consequently, two extreme answers have become mainstream: composition (the forming of a whole by its parts) happens under no or all conditions. In this paper, we provide a self-contained introduction to the integrated information theory of consciousness (...) (IIT). We show that IIT specifies a non-trivial restriction on composition: composition happens when integrated information is maximized. We compare the IIT-restriction to existing proposals and argue that the IIT-restriction has significant advantages, especially in response to the problems of vagueness and counterexamples. An appendix provides an introduction to calculating parts and wholes with a simple system. (shrink)

Integrated information theory is a theory of consciousness that was originally formulated, and is standardly still expressed, in terms of controversial interpretations of its own ontological and epistemological basis. These form the orthodox interpretation of IIT. The orthodox epistemological interpretation is the axiomatic method, whereby IIT is ultimately derived from, justified by, and beholden to a set of phenomenological axioms. The orthodox ontological interpretation is panpsychism, according to which consciousness is fundamental, intrinsic, and pervasive. In this paper it is argued (...) that both components of the orthodox interpretation should be rejected. But IIT should not be rejected since an interpretation-neutral formulation is available. After explaining the neutral formulation, more plausible non-axiomatic epistemologies are defended. The neutral formulation is then shown to be consistent with various contemporary physicalist ontologies of consciousness, including the phenomenal concept strategy, representationalism, and even illusionism. Along the way, instructive connections between interpretations of IIT and interpretations of quantum mechanics are noted. (shrink)

The many worlds interpretation of quantum mechanics (MWI) states that the world we live in is just one among many parallel worlds. It is widely believed that because of this commitment to parallel worlds, the MWI violates common sense. Some go so far as to reject the MWI on this basis. This is despite its myriad of advantages to physics (e.g. consistency with relativity theory, mathematical simplicity, realism, determinism, etc.). Here, we make the case that common sense in fact favors (...) the MWI. We argue that causal explanations are commonsensical only when they are local causal explanations. We present several quantum mechanical experiments that seem to exhibit nonlocal “action at a distance”. Under the assumption that only one world exists, these experiments seem immune to local causal explanation. However, we show that the MWI, by taking all worlds together, can provide local causal explanations of the experiments. The MWI therefore restores common sense to physical explanation. (shrink)

This article examines Schelling’s understanding of Laozi 老子. It begins with Schelling’s reception of Laozi’s text and its translation. The main part of this article focuses on Schelling’s discussion of Laozi in his Philosophy of Mythology. It then compares some of the key concepts mentioned in Schelling’s comments and their respective counterparts in Laozi: nothingness and wu 無, portal and abyss, reason and dao 道, name and concept, nature and ziran 自然, and so on, and analyzes the possible reasons for (...) his sympathetic understanding of Laozi as against his own philosophical system. The main argument is that Schelling’s romantic tendency means that he can have an alternative understanding of Laozi. Finally it concludes with a few remarks on the differences between Schelling and Laozi in terms of their philosophical systems and methods. (shrink)

Social practices are widely regarded as the bedrock that turns one’s spade, beneath which no further justifications for action can be found. Followers of the later Wittgenstein might therefore be right to agree with Heideggerians and neo-pragmatists that philosophy’s traditional search for first principles should be abandoned. However, the concept of practices has played a very different role in the philosophy of Alasdair MacIntyre. Having once helped lead the assault on foundationalism in both moral and social philosophy, his elaboration of (...) an Aristotelian’ concept of practices in After Virtue has since led him to embrace a metaphysical teleology. This paper attempts to outline MacIntyre’s Aristotelian concept, and to identify its ethical, political and philosophical significance. (shrink)

Aristotle is the most influential philosopher of practice, and Knight's new book explores the continuing importance of Aristotelian philosophy. First, it examines the theoretical bases of what Aristotle said about ethical, political and productive activity. It then traces ideas of practice through such figures as St Paul, Luther, Hegel, Heidegger and recent Aristotelian philosophers, and evaluates Alasdair MacIntyre's contribution. Knight argues that, whereas Aristotle's own thought legitimated oppression, MacIntyre's revision of Aristotelianism separates ethical excellence from social elitism and justifies resistance. (...) With MacIntyre, Aristotelianism becomes revolutionary. MacIntyre's case for the Thomistic Aristotelian tradition originates in his attempt to elaborate a Marxist ethics informed by analytic philosophy. He analyses social practices in teleological terms, opposing them to capitalist institutions and arguing for the cooperative defence of our moral agency. In condensing these ideas, Knight advances a theoretical argument for the reformation of Aristotelianism and an ethical argument for social change. (shrink)

William C. Frederick proposes a naturalistic business ethics. Many commentators focus on the issues of naturalistic fallacy, deprivation of freedom of the will, and possibility of important and universal moral values in business ethics. I argue that an ethics being naturalistic is not a worry. The issue of deprivation of free will is irrelevant. Yet there are urgent questions regarding the possibility of important and universal moral values, which may prevent Frederick’s view from getting off the ground.

Bioregionalism can strengthen environmental pragmatism by making it more critical of the status quo and even more environmental, without abandoning pragmatism's democratic aims. It thus answers important objections to pragmatism raised by Robyn Eckersley. Despite some apparent differences, bioregionalism is a form of environmental pragmatism, as it incorporates practical ethics and is committed to pluralism and democratic community. Bryan Norton's environmental pragmatism is already close to a bioregional view. After answering Eckersley, the paper concludes by raising the question of whether (...) environmental pragmatists should be bioregionalists. (shrink)

L’activité physique (AP) et les comportements de santé des élèves des classes et des écoles d’éducation spéciale (SECS) sont largement sous-étudiés. Le but de cette étude est de rendre compte du processus d’adaptation à ce public des enquêtes réalisées en population générale pour en améliorer la faisabilité et la comparabilité.Une série d’études a été réalisée. 1. Adaptation et test de l’enquête dans le SECS, 2. Recueil des données de l’étude pilote, 3. Tests supplémentaires pour une version simplifiée, 4. Recueil national (...) des données auprès des élèves du SECS. Les items du Washington Group Child Functioning Module (CFM) ont été progressivement améliorés. Des échelles visuelles analogiques et des items simplifiés ont été ajoutés. Le temps passé à répondre et la facilité de compréhension des questions ont été retenus comme critères de faisabilité de l’enquête. Près de la moitié des élèves (n=396/889) ont terminé la version simplifiée et ce, sur un temps de classe. De plus, les enseignants ont fait un retour positif sur la passation de l’enquête. Dans les enquêtes représentatives nationales, les instructions données doivent être claires. Les élèves du SECS peuvent avoir besoin d’aide pour comprendre les questions posées et des investigations supplémentaires sont nécessaires pour étudier les effets de cette aide sur la réalisation des enquêtes. The propositions that the senses are separate and that the global array may be sufficient for adequate perception are questioned. There is evidence that certain tasks may be primarily but these are a special case along the behavioral continuum. Many tasks involve sensory information that is ambiguous, and other sources of information may be required for adequate perception.

What makes some firms more innovative than others and what determines the source of these innovations are questions that are still not adequately answered due to the complex, often esoteric, nature of the innovation process. This paper considers the effect of one externally oriented strategy (extent of formal inter-organizational linkages) and one internally oriented strategy (degree of knowledge intensity) on overall levels of innovativeness and the source of these innovations. Using data collected from firms operating in the bioscience-technology industries in (...) both New York and Utah, our results suggest that both of these strategies have a significant effect upon innovation levels and the source of innovation (internally versus externally stimulated). Interestingly, there were few firms that undertook both of these strategies simultaneously and thus the proposed interaction effect where increased absorptive capacity (on the basis of knowledge intensity) would make external linkages even more valuable could not be discerned. The principle of mass additivity states that the mass of a composite object is the sum of the masses of its elementary components. Mass additivity is true in Newtonian mechanics but false in special relativity. Physicists have explained why mass additivity is true in Newtonian mechanics by reducing it to Newton’s microphysical laws. This reductive explanation does not fit well with deducibility theories of reductive explanation such as the modern Nagelian theory of reduction, and the a priori entailment theory of (...) reduction that is prominent in the philosophy of mind. Nonetheless, I argue that a reconstruction of the explanation that incorporates distinctively philosophical concepts in fact fits both theories. I discuss the implications of this result for both theories and for the reductive explanation of consciousness. (shrink)

The primary quantum mechanical equation of motion entails that measurements typically do not have determinate outcomes, but result in superpositions of all possible outcomes. Dynamical collapse theories (e.g. GRW) supplement this equation with a stochastic Gaussian collapse function, intended to collapse the superposition of outcomes into one outcome. But the Gaussian collapses are imperfect in a way that leaves the superpositions intact. This is the tails problem. There are several ways of making this problem more precise. But many authors dismiss (...) the problem without considering the more severe formulations. Here I distinguish four distinct tails problems. The first (bare tails problem) and second (structured tails problem) exist in the literature. I argue that while the first is a pseudo-problem, the second has not been adequately addressed. The third (multiverse tails problem) reformulates the second to account for recently discovered dynamical consequences of collapse. Finally the fourth (tails problem dilemma) shows that solving the third by replacing the Gaussian with a non-Gaussian collapse function introduces new conflict with relativity theory. (shrink)

This paper explores the prospects for a Pritchardean epistemological disjunctivist account of memory knowledge. We begin by providing an overview of Duncan Pritchard's epistemological disjunctivist account of perceptual knowledge, as well as the theoretical advantages of such an account. Drawing on that account, we present and motivate our own Pritchardean epistemological disjunctivist account of memory knowledge. After distinguishing different sorts of memory and the different roles that memory can play in knowledge acquisition, we set out our account and argue that (...) the case for epistemological disjunctivism enjoys parity with the case for epistemological disjunctivism of perceptual knowledge. We also consider objections to our account. The first is from Joe Milburn and Andrew Moon, who argue against a general epistemological disjunctivism of memory on the basis of differences in memory types. The second objection arises from a Radford-like case whereby one's true belief is from memory even though one lacks rational support that is reflectively accessible to one. (shrink)

In this essay Kelvin Beckett argues that Richard Peters's major work on education, Ethics and Education, belongs on a short list of important texts we can all share. He argues this not because of the place it has in the history of philosophy of education, as important as that is, but because of the contribution it can still make to the future of the discipline. The limitations of Peters's analysis of the concept of education in his chapter on “Criteria (...) of Education” are well known. In the chapter on “Education as Initiation,” however, Peters offered a synthetic sketch of education that, Beckett argues, points us toward a more comprehensive definition of education, one which, he maintains, can be accepted by all philosophers, regardless of the tradition they work in. In Prajñā and Reason Nishitani presents a powerful vision of philosophy as Absolute knowing. Nishitani’s conclusions are striking: Absolute knowing can only fulill its potential by beginning without any presuppositions and affirming the truth of contradiction. Because Hegel’s philosophy also purports to be a science of Absolute knowing, in Prajñā and Reason Nishitani develops his own account of the Absolute in conversation with Hegel’s philosophy. We reconstruct Nishitani’s reading and various critiques of Hegel, and thereafter evaluate its merits. Our inquiry (...) shows that Hegel too begins without presuppositions and affirms the truth of contradiction. As a result, we argue that Nishitani’s profound reflections on Absolute knowing draw him into close proximity with Hegel’s thinking and call us to re-think the very being of philosophy and philosophical practice today. Does consciousness collapse the quantum wave function? This idea was taken seriously by John von Neumann and Eugene Wigner but is now widely dismissed. We develop the idea by combining a mathematical theory of consciousness (integrated information theory) with an account of quantum collapse dynamics (continuous spontaneous localization). Simple versions of the theory are falsified by the quantum Zeno effect, but more complex versions remain compatible with empirical evidence. In principle, versions of the theory can be tested by experiments with (...) quantum computers. The upshot is not that consciousness-collapse interpretations are clearly correct, but that there is a research program here worth exploring. (shrink)

Among the many theories that explain the becoming of all things in the universe, there is a metaphysical viewpoint that all things are originated from one pure origin which is preceded by nothing. This metaphysical viewpoint can be called the idea of genesis. Derrida proposes that this concept of ‘genesis’ itself is founded upon a contradiction; ‘genesis, …, brings together two contradicting meanings in its concept: one of origin, one of becoming.’, p. xxi.) Based on this paradox, Derrida proposes that (...) all philosophical attempts to recover the pure origin here-and-now, which are categorized as the metaphysics of presence, are impossible. In this paper, I argue that Derrida’s criticism is based on the Augustinian question of time which presupposes that only the present moment is real. Recovery of the origin therefore means to reduce the non-present to the present. I contend that Daoism can respond to Derrida’s criticism because it possesses a nested idea of time—the idea that each present is encompassed by a deeper level of present as the background context. Accordingly, the recovery of origin does not mean to return to an elapsed past but a deeper context of all occurrence. This explains why dao, when it is understood as the origin of things in the world, does not succumb to Derrida’s criticism. Furthermore, it provides an alternative solution to the Derridean paradox of genesis. (shrink)

Children who grow up with a life‐threatening illness live and face death in a way that is foreign to those of us who have reached adulthood in relative health. The experiences that form their identities create a range of knowledge, and processes for acquiring that knowledge, quite apart from the mainstream. In the pace of its acquisition, and the depth of its content, this knowledge is hard for the rest of us to comprehend. Indeed, the primary symptom of this alternate (...) cognizance is that it sets these children apart from their families, peers, and greater communities. The child as a whole is marginalized in interpersonal relations by essentializing the child as the illness. The experience of the illness itself further isolates the child.Through firsthand observation, we find that the Hole in the Wall Gang summer camps provide a nearly unique environment for the normalization of this alternate cognizance. At camp, all those things that set them apart from the rest of the world mark them as normal members of a society. Other children share their physical qualities, have similar experiences and immediately understand their perspective on life. Small adjustments to social and physical environments have a lasting effect. A warm pool to swim in, a caring touch, an open smile—the children take the memory of these with them when they leave. They begin to understand that they are a desired part of a large and varied community. A new definition of normal is created and they are included. (shrink)
